MISTOWA DMCA POLICY
MISTOWA respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), MISTOWA will respond to appropriate notices of alleged copyright infringement.
If you believe that your copyrighted work has been copied and is accessible on MISTOWA in a way that constitutes copyright infringement, please provide the following information to our Copyright Agent:
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed
- Identification of the copyrighted work claimed to have been infringed
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled
- Information reasonably sufficient to permit MISTOWA to contact you, such as an address, telephone number, and email address
- A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed

If you believe that your content has been removed or disabled by mistake or misidentification, please provide the following information to our Copyright Agent:
- Your name, address, telephone number, and email address
- A description of the content that was removed or disabled and the location of the content before it was removed or disabled
- A statement that you have a good faith belief that the content was removed or disabled as a result of a mistake or misidentification
- A statement, under penalty of perjury, that you are the owner of the content or are authorized to act on the owner’s behalf
Counter-Notice
If you believe that your content was removed or disabled as a result of a mistake or misidentification, you may file a counter-notice with MISTOWA’s Copyright Agent. To be effective, a counter-notice must be a written communication that includes the following:
- Your physical or electronic signature
- Identification of the content that has been removed or to which access has been disabled and the location at which the content appeared before it was removed or disabled
- A statement that you have a good faith belief that the content was removed or disabled as a result of a mistake or misidentification
- Your name, address, telephone number, and email address
- A statement that you consent to the jurisdiction of the federal court in the District of New York and that you will accept service of process from the person who provided the original complaint or an agent of such person
After MISTOWA receives a valid counter-notice, it may replace the removed content or cease disabling access to it in 10 business days, unless MISTOWA’s Copyright Agent receives notice from the original complaining party that it has filed an action seeking a court order to restrain the alleged infringer from engaging in infringing activity relating to the content on MISTOWA’s system or network.
Please note that, in accordance with the DMCA, any person who knowingly makes misrepresentations in a notice or counter-notice may be liable for damages.
